These general terms and conditions govern the pressure washing services carried out by AquaNet Pro. They apply to every order, unless special conditions are agreed in writing. The customer acknowledges having read and accepted them before confirming the order.
1. Quote and order
Our quotes are free and valid for 30 days. The order is confirmed by written acceptance of the quote (signature, email or express agreement). The quote specifies the service, the area, the price and any options. A deposit may be requested when the order is confirmed; it is deducted from the final invoice.
2. Price, VAT and additional work
Prices are expressed in euros. The applicable VAT is the rate in force on the day of the service (21%). The price may be adjusted if the actual area or condition differs significantly from that stated in the quote; any adjustment is communicated to the customer before the service continues. Any work not provided for in the quote requires prior written agreement and is invoiced separately.
3. Customer obligations and declarations
To allow the service to be carried out properly, the customer undertakes to:
- provide access to water and, if necessary, to electricity;
- guarantee safe and clear access for the equipment;
- remove or protect movable, fragile or valuable items (furniture, pots, decorations, vehicles, etc.), close doors and windows and protect sensitive items nearby;
- report in advance and in writing any item likely to be damaged or to present a risk: fragile or recent surface, loose joints, cracks, possible water ingress, outdoor electrical installation, visible or concealed pipe or waterproofing membrane, plants, etc.;
- keep people, children and animals away from the area throughout the work.
If these obligations are not met, AquaNet Pro cannot be held liable for any resulting damage.
4. Performance of the service
AquaNet Pro has an obligation of means and applies its expertise to achieve an optimal result. Work dates are given as an indication only, unless a deadline has been expressly agreed as essential between the parties. Work may be postponed, without compensation, in the event of unfavourable weather conditions (frost, heavy rain, wind). AquaNet Pro adapts the method and pressure used to the nature and condition of the surface.
5. Result and guarantee
Pressure washing is an obligation of means: the result depends on the nature, age, porosity and condition of the surface. Some ingrained stains, marks, deep-rooted moss, efflorescence or discolouration may remain despite work carried out in accordance with good practice; this does not constitute a defect in the service. No guarantee is given against re-soiling, biological regrowth or new dirt appearing after the work. A protective treatment or additional maintenance may be offered and is invoiced separately.
6. Acknowledgement of the initial condition of the surface
The customer may request a joint inspection of the condition of the surface before the work begins. In the absence of a written reservation made before the work starts, the surface is deemed free of visible defects and fit to be treated. Pre-existing defects (cracks, loose elements, weakened surfaces, previous damage), whether detectable or not, remain the customer's responsibility.
7. Cancellation and postponement by the customer
Without prejudice to the right of withdrawal provided for in article 8, the customer may cancel or postpone the service free of charge up to 48 hours before the agreed date. If cancelled less than 48 hours before the work, compensation covering costs already incurred (reserved slot, travel, preparation) is due, up to 30% of the quote amount. If cancelled on the day itself, or if the work cannot take place due to a lack of access attributable to the customer, this compensation may reach 50% of the quote amount. Conversely, if AquaNet Pro cancels for a reason other than force majeure or weather conditions, it will offer a new date or refund the deposit paid. These amounts are indicative and may be reduced by the courts.
8. Right of withdrawal (consumers)
For contracts concluded at a distance or off-premises, the consumer has 14 days to withdraw, without giving any reason, in accordance with the Belgian Code of Economic Law. The period runs from the conclusion of the service contract.
If you wish the service to begin before the end of this period, you must expressly request it. You then acknowledge that you lose your right of withdrawal once the service has been fully performed. If you withdraw after requesting that performance begin, you pay an amount proportional to the service already provided.
Model withdrawal form: « For the attention of AquaNet Pro, Schaveyslaan 20, 1650 Beersel — contact@aquanetpro.be: I hereby give notice that I withdraw from the contract for the following service [...], ordered on [...]. Name, address, date and signature. »
9. Payment
Unless otherwise agreed, the invoice is payable within 15 days. In the event of late payment, a first reminder is sent free of charge before any surcharge, in accordance with the regulations on the amicable recovery of consumer debts. Late-payment interest and fixed compensation may then be applied, in accordance with the legislation in force. AquaNet Pro reserves the right to suspend any service in progress in the event of non-payment.
10. Complaints and recording of damage
Any complaint about the service must be sent in writing (email or letter) to AquaNet Pro.
Any visible damage must be reported no later than 8 calendar days after the work. To allow a joint inspection, the customer undertakes not to restore, alter or repair the area concerned, nor have a third party work on it, before AquaNet Pro has been able to record the damage, on site or on the basis of conclusive, dated evidence (photographs in particular).
If no report is made within this period, or if the condition of the area has been altered in such a way that an objective assessment is no longer possible, the complaint can no longer be considered admissible.
AquaNet Pro examines every admissible complaint in good faith and responds within a reasonable time.
11. Liability and limitation
AquaNet Pro holds professional liability insurance.
Some fragile, porous, old or already damaged surfaces present inherent risks which, as far as possible, are pointed out to the customer before the work. AquaNet Pro cannot be held liable for damage resulting from a pre-existing defect, weakness, wear or lack of maintenance of the surface, whether detectable or not.
AquaNet Pro's liability is limited to direct and foreseeable material damage resulting from a proven fault in the performance of the service. Indirect and immaterial damage, such as operating loss, loss of enjoyment, loss of income or any other consequential loss, is expressly excluded.
In any event, and whatever the nature of the damage, the compensation payable by AquaNet Pro is capped at the amount actually covered by its professional liability insurer for the claim concerned. If the insurer does not cover the claim, compensation may not exceed the total amount of the invoiced service.
The above limitations and exclusions do not apply in the event of fraud, gross negligence by AquaNet Pro, or harm to life, physical integrity or health, in accordance with the mandatory provisions of Belgian law.
12. Force majeure
AquaNet Pro cannot be held liable for any failure due to force majeure (exceptional weather, water restriction or cut-off, major equipment breakdown, etc.). Performance is then suspended and resumed as soon as possible.
13. Photos and references
AquaNet Pro may take before/after photographs of the service and use them for reference or promotional purposes, in a form that does not allow the customer, their home or any person to be identified. The customer may object at any time by simple written request.
14. Subcontracting
AquaNet Pro may entrust all or part of the service to a qualified subcontractor, while remaining the customer's point of contact and responsible for proper performance within the limits of these terms.
15. Personal data
The processing of your data is described in our privacy policy.
16. Final provisions
The invalidity or unenforceability of any clause of these terms does not affect the validity of the other clauses, which remain fully applicable. AquaNet Pro's failure to assert a right at any given time does not constitute a waiver of that right. The accepted quote and these general terms and conditions constitute the entire agreement between the parties. AquaNet Pro may assign the contract, in particular in the event of a transfer of business.
17. Applicable law, disputes and mediation
These terms are governed by Belgian law. In the event of a dispute, and without prejudice to consumer protection rules, the courts of the competent judicial district have sole jurisdiction. Before taking any legal action, the consumer may, in accordance with Book XVI of the Code of Economic Law, refer the matter free of charge to the Consumer Mediation Service: Boulevard du Roi Albert II 8 box 1, 1000 Brussels — 02 702 52 20 — contact@mediationconsommateur.be — mediationconsommateur.be.
